QCan you appeal a non-selection for promotion to MSPB?

Usually no. The Merit Systems Protection Board only hears cases that law or rule makes appealable to it. A non-selection for promotion normally is not one of them. The narrow exceptions run through VEOA and USERRA claims.

QCan you file a grievance over a denied federal promotion?

You can file a complaint about a promotion action. But 5 CFR 335.103(d) says nonselection from a group of properly ranked and certified candidates is not a proper basis. How candidates were found and ranked can be. Read your union contract or agency procedure first.

QHow long do you have to contact an EEO counselor?

You contact an agency EEO counselor within 45 days of the action. If counseling or mediation does not settle it, you get 15 days from that notice to file a formal complaint. Call your EEO office and confirm the dates for your own case.

QCan your supervisor deny a career ladder promotion?

Yes. Career ladder promotions are not automatic. Under 5 CFR 335.104 your current rating of record has to be Fully Successful or higher. Your supervisor also has to back that you can perform at the next grade.

QDoes veterans preference apply to a federal promotion?

No. OPM's Vet Guide says preference does not apply to promotion, reassignment, change to lower grade, transfer or reinstatement. It also does not apply to merit promotion actions. VEOA lets eligible veterans compete when an agency opens an announcement outside its own workforce.

QWhat should you ask your supervisor after a denied promotion?

Ask what the selected candidate showed that your package did not. Ask which part of the specialized experience read thin. Ask what would earn a yes next cycle, and by when. Then recap the answers in an email the same day.

QHow soon should you apply again after a federal non-selection?

Rebuild the record first, then apply. Give yourself 30 days for feedback and 30 days for the rewrite. Aim to submit a real package inside 90 days. Resending the package that just lost rarely changes the result.
